Contract Terms and Conditions
It is understood that Gary Gionet is the official exclusive photographer retained to perform the photographic services requested under this contract.
When there are additional services provided, or when the scope and nature of the actual services exceed this contract by client request, additional payments are required.
There may be reimbursements due in addition to this contract for any outside services or expenditures, for items including but not limited to: reimbursements for long distance telephone calls, overnight package delivery, and other services rendered on behalf of the client.
No part of any order will be delivered until the balance is paid in full.
In the event of postponement or cancellation of the contract, all deposits are non-refundable.
Only in case of re-scheduling to a date when the photographer is not yet committed to another contract may the services be rescheduled. In event of rescheduling, a 25% surcharge will be added to the quoted rate, with full credit provided for the deposit paid by the client.
The photographer takes utmost care with the respect to exposure, development and delivery of services and photographs. However, in the event the photographer fails to comply with the terms of the contract due to any event or act outside the control of the photographer, the photographer's liability is limited to a refund of deposits.
The photographer will do his utmost to capture specific images of persons, groups of persons or specific scenes. It is vital that the customer advise the photographer in advance of such expectations and provide assistance during the event to identify the subject persons.
The photographer delivers a large quantity of proofs to the customer in order to assure a variety of choices. These are intended as the proof set from which the client may choose which to include in the final selection in the album. The proofs are of high paper and print quality and suitable for an album.
The proofs not selected for inclusion in an album may be kept by the customer to dispense with as desired. However, because photography is not a perfect art, the photographer does not guarantee that each and every proof provided for selection purposes is photographically perfect. In some proofs imperfections may be evident.
Notice of Copyright: It is illegal to copy or reproduce these photographs elsewhere without the photographer's permission. Violators of this Federal Law will be subject to civil and criminal penalties.
Only photograph packages offered with specific permission to reproduce the negatives (film/digital) under limited copyright license are permitted.
The photographer is not responsible for interference by professional or amateur video camera operators at the event which affect the quality of the photo services rendered.
